About these Terms

These Terms of Service govern your use of dirtytoyz.com and purchases made from DirtyToyz. The seller and contracting business is:

By accessing the store, creating an account or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the store.

Eligibility — adults only

You must be at least 18 years old or the higher legal age of majority in your jurisdiction to access or purchase from DirtyToyz.

By using the store, you confirm that you meet this requirement and may legally purchase and possess the products offered. You may not purchase for a minor or allow a minor to use your account.

Accounts & information

You agree to provide current, complete and accurate account, billing, payment and delivery information. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account where permitted by law.

Notify us promptly if you believe your account has been accessed without authorisation. We may suspend or close accounts involved in fraud, abuse, unlawful activity or material violations of these Terms.

Products, availability & orders

We aim to describe and display products accurately. Colours, textures and scale may appear differently depending on screens, photography and manufacturing tolerances. Product measurements may have reasonable minor variations.

Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may reject or cancel an order before dispatch for reasons including:

• product unavailability or listing error;
• incorrect pricing or payment failure;
• suspected fraud, abuse or resale activity;
• delivery or legal restrictions; or
• information that cannot be verified.

If we cancel an order after payment, we will refund the affected amount.

Order limits

We may limit quantities per person, household, account, payment method or delivery address where reasonably necessary to protect customers, inventory or the store.

Prices, taxes & payments

Prices are displayed in the selected store currency. Currency conversion and final amounts may vary depending on market, payment provider and card issuer.

For European Union deliveries, applicable VAT is included in the displayed price or collected at checkout. Other duties, taxes and import charges may apply as described in our Shipping Policy.

Available methods may depend on device, country, currency and payment-provider approval. By submitting payment information, you confirm that you are authorised to use the selected method.

Processing, delivery & risk

Orders are normally processed the same day or within one business day and shipped free in one discreet parcel. Delivery times are estimates, not guarantees.

Delivery destinations, tracking, customs, VAT, address errors, delays and lost-parcel investigations are governed by our Shipping & Delivery Policy.

Risk of loss passes to a consumer when the customer or a person designated by the customer receives physical possession of the goods, except where applicable law provides otherwise.

Customs and local legality

You are responsible for checking whether purchasing, importing, possessing and using a particular product is lawful in your country or region. DirtyToyz cannot guarantee that every product is permitted in every jurisdiction.

You are responsible for applicable customs duties and import charges. Refusing charges or customs clearance does not automatically create a right to a full refund.

Cancellations, returns & refunds

Orders may be cancelled only before dispatch. Returns of intimate hygiene goods are restricted after the individual factory seal is opened, except for defective, damaged, incorrect or non-conforming goods.

Safe and lawful product use

DirtyToyz products are intended for adult personal use. Read and follow the instructions, warnings, cleaning guidance and material-care information provided with the product or on the store.

• Inspect products before each use and stop using any damaged item.
• Use products only for their intended purpose and within personal comfort and experience.
• Use a compatible lubricant. For silicone toys, water-based lubricant is generally recommended; avoid silicone- or oil-based products unless the product instructions expressly state they are compatible.
• Clean and store products according to the supplied care instructions.
• Do not share intimate products unless they are designed for sharing and appropriately protected and sanitised.

You assume responsibility for choosing a product suitable for your body, experience and intended use. This does not exclude liability for defective or unsafe products where liability cannot lawfully be limited.

Email communications

We send essential transactional emails about orders, payments, delivery, security, returns and support.

Where permitted, we may also send newsletters, offers, review requests, product updates and abandoned-cart reminders. Marketing emails include an unsubscribe option. Unsubscribing from marketing does not stop essential transactional messages.

Reviews & customer content

If you submit a review, image, video, comment or other content, you confirm that:

• you own it or have permission to submit it;
• it is truthful and relates to your genuine experience;
• it does not violate privacy, intellectual-property or other rights;
• it does not contain unlawful, threatening, deceptive or malicious material; and
• it does not expose personal information you do not want displayed publicly.

You grant ROSPRO 2018 LTD a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, translate and display submitted content for operating and promoting DirtyToyz, subject to applicable law and our Privacy Policy.

We may moderate or remove content that violates these Terms, but are not required to publish every submission.

Intellectual property

The DirtyToyz name, logos, website design, product photography, graphics, copy, video and other original store content are owned by or licensed to ROSPRO 2018 LTD and protected by applicable intellectual-property laws.

You may use the store only for personal, non-commercial shopping. You may not reproduce, scrape, copy, republish, sell, exploit or create derivative works from protected content without written permission, except where law allows.

Prohibited use

You must not use the store to:

• break any law or infringe another person’s rights;
• purchase products for a minor;
• submit false information, fraudulent payments or abusive claims;
• introduce malware, interfere with security or attempt unauthorised access;
• scrape, crawl or harvest data except as lawfully authorised;
• impersonate another person or misrepresent an affiliation;
• harass staff, customers or service providers; or
• circumvent country, age, checkout or fraud-prevention controls.

We may restrict access, cancel unfulfilled orders or take other proportionate action when these rules are violated.

Third-party services & links

The store relies on third parties including Shopify, payment services, review tools, analytics, fulfilment partners, carriers and tracking providers. Their services may be governed by separate terms and privacy notices.

External links are provided for convenience. We are not responsible for unrelated third-party websites, content or practices, except where applicable law provides otherwise.

Disclaimers & liability

We provide the store with reasonable care but cannot promise that access will always be uninterrupted, error-free or immune from circumstances outside our control.

To the maximum extent permitted by law, ROSPRO 2018 LTD is not liable for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a consumer purchase.

Nothing in these Terms excludes or limits liability where exclusion is unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory product and consumer rights.

Events outside reasonable control

We are not responsible for delay or failure caused by events outside reasonable control, including severe weather, natural disasters, war, civil disruption, public-health emergencies, customs action, carrier interruption, government restrictions or failures of essential networks. We will take reasonable steps to minimise disruption.

Governing law & disputes

These Terms and contracts with ROSPRO 2018 LTD are governed by the laws of the Republic of Bulgaria.

If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your habitual residence. You may also have the right to bring proceedings in the courts available to you under mandatory consumer law.

Changes, severability & entire agreement

We may update these Terms for legal, operational or service changes. The version displayed when an order is placed normally governs that order unless law requires otherwise.

If a provision is found invalid or unenforceable, the remaining provisions continue to apply. These Terms and the policies referenced in them form the agreement between you and ROSPRO 2018 LTD regarding store use and purchases.
